Terms and Conditions

Effective date: 5 September 2026  |  Version: 5 September 2026

These Terms are published by Geeks CRS. The legal entity responsible for operating Geeks CRS and supplying an individual transaction will be identified on the applicable quotation, booking confirmation, service agreement, order or invoice.

About These Terms

These Terms and Conditions apply to goods and services supplied by the Geeks CRS contracting entity identified on the customer’s quotation, booking confirmation, service agreement, order or invoice.

In these Terms:

  • “Geeks CRS”, “we”, “us” and “our” refer to the contracting entity identified on the relevant transaction document.
  • “Customer”, “you” and “your” refer to the person or organisation purchasing or receiving the goods or services.
  • “Goods” include computers, devices, components, accessories, replacement parts, networking equipment and other products supplied by Geeks CRS.
  • “Services” include onsite support, remote support, diagnosis, repair, installation, configuration, maintenance, data transfer, data recovery, cybersecurity assistance, scam-related assistance, training and other agreed technology services.

These Terms apply together with any accepted quotation, booking confirmation, service agreement, order or invoice. If a transaction document contains a specific term applying to that transaction, that term applies together with these Terms.

Nothing in a transaction document or these Terms excludes, restricts or modifies any right, guarantee, remedy or protection that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the transaction and circumstances:

  • Goods must be of acceptable quality;
  • Goods must be fit for any disclosed purpose that Geeks CRS accepts;
  • Goods must match their description;
  • Goods must match any sample or demonstration model where applicable;
  • Services must be provided with due care and skill;
  • Services must be fit for any purpose or result made known by the customer and accepted by Geeks CRS; and
  • Services must be supplied within the agreed period or, where no period is agreed, within a reasonable time.

Where goods have a major failure, the customer may be entitled to choose a refund or replacement in accordance with the Australian Consumer Law. Where a failure with goods is not major, Geeks CRS may provide an appropriate remedy within a reasonable time.

Where services have a major failure, the customer may be entitled to cancel the service contract and obtain the remedies provided by the Australian Consumer Law. Where a service failure is not major and can be remedied, Geeks CRS may remedy the failure within a reasonable time.

Customers may also be entitled to compensation for reasonably foreseeable loss or damage resulting from a failure to comply with an applicable consumer guarantee. A voluntary Geeks CRS warranty or manufacturer’s warranty is additional to Australian Consumer Law rights and does not replace, restrict or limit those rights.

Quotes, Bookings and Acceptance

A quotation, booking or preliminary discussion does not guarantee that a particular technical outcome is possible.

Before a customer commits to a material purchase or substantial service, Geeks CRS will take reasonable steps to disclose:

  • The proposed scope of work;
  • The goods or services to be supplied;
  • The price or pricing basis;
  • Known call-out, diagnostic, travel, delivery or third-party charges;
  • Known material limitations;
  • Any deposit or advance payment required;
  • An estimated delivery or completion period where reasonably possible; and
  • Material cancellation conditions applying to the transaction.

The customer may accept a transaction through a signed service agreement, written acceptance of a quotation, an online booking or payment process, email or text-message confirmation, recorded verbal approval, payment following clear disclosure, or another method that reasonably demonstrates informed acceptance.

Customer acceptance confirms approval of the disclosed goods, services, scope and price. Acceptance does not remove or reduce any right available under the Australian Consumer Law. Where the account holder, payer and intended user are different people, Geeks CRS may require reasonable evidence that the person approving the transaction has authority to do so.

Technical Diagnosis and Recommendations

Technical recommendations are based on the information reasonably available to Geeks CRS at the time. Geeks CRS will take reasonable steps to understand the reported issue, identify operational requirements, distinguish between a preliminary opinion and a confirmed diagnosis, carry out testing before recommending replacement equipment, explain material limitations, identify practical alternatives, and obtain approval before performing additional work.

Geeks CRS will not represent that equipment must be replaced unless that recommendation is reasonably supported by the assessment undertaken at the time.

A diagnosis may change following further testing, disassembly, receipt of additional information or identification of another fault. Any material change to the recommended solution, scope or price requires further customer approval before Geeks CRS proceeds.

Pricing and Payment

Geeks CRS prices may vary according to the type, complexity, location, timing and requirements of the service. Applicable prices will be provided through the quotation, booking confirmation, service agreement, order or invoice.

Before the customer commits to a transaction, Geeks CRS will disclose total prices (inclusive of GST where applicable), known charges, deposit requirements, and payment methods. Total minimum prices will be displayed as prominently as component prices.

Geeks CRS will obtain approval before performing material additional work or supplying additional goods, except where urgent action is reasonably necessary to prevent damage or address an immediate safety or security risk and the customer cannot reasonably be contacted.

Geeks CRS may require a reasonable deposit or advance payment for ordered hardware, custom configurations, or third-party costs. Advance payments do not remove Geeks CRS’s obligation to supply the agreed goods or services within the agreed or reasonable period.

Receipts, Invoices and Proof of Purchase

Geeks CRS will provide receipts, tax invoices and itemised service bills as required by law. Receipts will identify business details, ABN/ACN, supplied items/services, date, and amounts paid.

Where an itemised service bill is requested within applicable statutory periods, Geeks CRS will provide it within the required period showing labour hours, hourly rates, materials, and third-party charges.

Proof of purchase may include payment records, bank statements, booking references, serial numbers, or other records reasonably demonstrating purchase.

Delivery and Completion Periods

Stated delivery, attendance or completion dates are estimates unless expressly agreed in writing as guaranteed or essential. If a material delay occurs, Geeks CRS will notify the customer and provide available options (e.g., continuing under revised timeframe, alternative solutions, order cancellation, or appropriate statutory remedies).

Notice Before Repairs

Before accepting goods for repair, Geeks CRS will provide any repair notice required by the Australian Consumer Law.

Customers acknowledge that diagnosis, repair, upgrade, maintenance and data recovery may involve a risk of data loss. Customers should maintain a current backup. Geeks CRS may use new, refurbished or equivalent replacement components where appropriate and permitted by law, with proper legally required notice given.

Aged, Fragile and Previously Damaged Equipment

Customers acknowledge that equipment presented may be old, heavily used, previously repaired/opened, physically damaged, or affected by liquid or environmental exposure. Procedures requiring disassembly, heating, or moving may cause weakened parts (clips, flex cables, screens, plastics, adhesives) to crack or detach due to pre-existing conditions.

Geeks CRS exercises due care and skill. Where a significant foreseeable risk is identified, Geeks CRS will explain the risk and obtain approval prior to proceeding. Geeks CRS is not responsible for damage caused solely by pre-existing defects, wear, or prior repairs that Geeks CRS did not cause.

Customer Authorisation for High-Risk Work

Where significant repair risks are identified, Geeks CRS may require written or recorded approval before proceeding (including notes, photos, identified risks, and customer choices). Approval of disclosed inherent risks does not authorise negligent work or remove obligations of due care and skill.

Data, Backups and Privacy

Customers should maintain a current backup of important information before diagnosis, repair, upgrade, or recovery. Geeks CRS exercises due care when handling customer equipment and data, but data recovery cannot be guaranteed due to storage media corruption, physical damage, or encryption.

For data recovery tasks, file access is restricted to authorised personnel strictly for technical verification. Recovered data will only be released to the customer or authorised representative. Personal information is handled in accordance with the Geeks CRS Privacy Policy.

Customer Devices and Property

Geeks CRS records equipment taken into custody (make, model, serial number, visible condition). Proof of identity or authority may be required before releasing devices, property, or recovered data upon job completion.

Security, Scam Assistance and Account Recovery

Security and scam-related services carry inherent third-party limitations. Unless expressly agreed, Geeks CRS cannot guarantee that every threat will be removed or transferred money recovered. Account recovery depends on third-party security checks and ownership proofs which Geeks CRS cannot override.

Remote Support

Geeks CRS will obtain permission before remotely accessing a customer device. Customers may terminate a remote session at any time. Geeks CRS will only access relevant systems, avoid unrelated files, and end the session when completed.

Appointments and Customer Access

The customer must provide accurate contact details, safe environment access, hazard notices, and a responsible adult present at residential on-site appointments. Geeks CRS may suspend or reschedule work if locations are unsafe or required information is missing.

Customer Cancellation or Rescheduling

Customers may request cancellation or rescheduling via booking contact details. Cancellation charges, if applicable, reflect reasonable incurred costs or reserved technician time as disclosed prior to acceptance, fully complying with Australian Consumer Law requirements.

Geeks CRS Cancellations and Rescheduling

Geeks CRS may reschedule due to technician unavailability, safety concerns, or events outside operational control with as much notice as practicable. If Geeks CRS cannot provide the service within an agreed timeframe, the customer may cancel and receive an appropriate refund.

Change-of-Mind Cancellations

The Australian Consumer Law does not automatically require refunds for change-of-mind requests on conforming goods/services. Geeks CRS may consider change-of-mind cancellations at its discretion, taking into account completed work and re-stocking conditions.

Unsolicited Consumer Agreements

Where applicable (e.g., door-to-door or telemarketing approaches), Geeks CRS complies with mandatory contact rules, written agreement delivery, and statutory 10-business-day cooling-off period rights.

Additional Faults and Work Outside Scope

Geeks CRS is not responsible for faults caused solely by customer misuse, third-party software/hardware, physical/liquid damage, or unauthorized modifications. Separate quotes will be issued for extra scope items.

Third-Party Goods and Services

Third-party hardware carries manufacturer warranties in addition to ACL rights. Geeks CRS remains responsible for its own service representations and installation configurations.

Software Licences and Lawful Use

Customers must possess valid software licences. Geeks CRS will not knowingly install counterfeit or unauthorised software.

Australian Consumer Law Remedies & Separate Warranties

ACL rights are not limited to fixed warranty windows. Voluntary warranties provided operate alongside statutory consumer rights.

Complaints and Refunds

Complaints can be lodged via our booking confirmation contact details. Approved refunds will be processed back to the original payment method without unlawful fee deductions.

Uncollected Goods

Geeks CRS will take reasonable steps to contact customers regarding uncollected items and comply with applicable statutory notice waiting periods and disposal regulations.
